U.S. National Security Reform: Promoting Stability and Rule of Law in Fragile States

TIME: 6:00 p.m. - 7:30 p.m. (ET) Reception immediately following. The National Security Strategy is revisited with each U.S. presidential administration. According to a study from the Project on National Security Reform, national security is defined as the capacity of the United States to define, defend, and advance its position in a world characterized by turbulent forces of change . . . [including] a national capacity to shape the strategic environment [and] to anticipate and prevent threats. The current Strategy promotes cooperation between defense and diplomacy on issues including advancing rule of law. Consistent with the Strategy, the U.S. Department of State and the U.S. Agency for International Development together in 2010 undertook the first Quadrennial Diplomacy and Development Review (QDDR), inspired by the Quadrennial Defense Review (QDR) and over the past year and a half have been implementing policy changes and significant institutional reforms. The QDDR identifies civilian power as a central pillar of U.S. national security policy and elaborates on Secretary Clinton’s concept of “smart power”—blending principles and pragmatism to make “intelligent use of all means at the disposal” of the U.S.—defense, diplomacy, and development. Some scholars and policy observers argue that national security problems have become increasingly complex and the U.S. Strategy accordingly requires enhanced guidance and multi-agency cooperation to meet these challenges. What are the threats to national security posed by fragile states? What is the role for advancing rule of law to stabilize fragile states within this national security paradigm? At this time of reform, and with additional policy shifts likely on the horizon, what are the most pressing priorities for the National Security Strategy and advancing rule of law?

The Law and Practice of Rehabilitation in Domestic Reparation Programmes

The Essex Transitional Justice Network at the University of Essex, with the support of the Clemens Nathan Research Centre and the Transitional Justice and Rule of Law Interest Group of the American Society of International Law, is organizing this international two-day conference. Rehabilitation as a form of reparation for gross violations of international human rights law generally receives sparse attention in literature and in practice, despite the vital and immediate role it can play in a victim’s recovery as well as the range of actors within different disciplines who work on rehabilitation. Focusing on transitional justice, this conference will explore the normative and legal role of rehabilitation as a form of reparation in times of transition. It will also examine the extent to which a range of established and nascent administration reparation programmes address rehabilitation within their mandate and the impact of this inclusion or neglect thereof. The purpose of this discussion will be to gain a better appreciation of good practice for focusing on the challenges associated with dealing with rehabilitation in times of transition, and to have consistency and clarification of the obligations of states in relation to rehabilitation when establishing administrative reparation programmes. ASIL-ESIL International Legal Theory Workshop

On many levels, the interaction between North American international legal scholarship and its European counterpart(s) is working very well. Time and again, however, one finds that the underlying theoretical or philosophical framework is radically different. In this workshop the International Legal Theory Interest Groups of the American Society of International Law and the European Society of International Law would like to explore that difference without letting themselves be defined by it. Contributions analyzing, criticizing, denying or celebrating the difference are welcome, as well as papers exemplifying the various theoretical approaches to international law, be they "American," "European," or neither. The most important function of this workshop is to intensify the transatlantic theoretical debate by bringing together scholars with diverse disciplinary, philosophical, and methodological perspectives to discuss cutting-edge research on international legal theory.

Ninth Annual Seminar on International Commercial Arbitration: How to Handle a BIT Arbitration

This three-day intensive seminar based on a mock arbitration case will provide critical skills and practical insight into handling BIT arbitration cases primarily under the auspices of the International Centre for Settlement of Investment Disputes (ICSID). The faculty, composed of leading practitioners in the field, will draw upon their experience as arbitrators and litigators to give detailed practical guidance on the various stages of the arbitration, including: preliminary steps in ICSID Arbitration; preparatory conference and arbitral procedure; the arbitration request; the answer to the arbitration request; selection and rights and duties of arbitrators; evidentiary issues; the arbitral award; and enforcement of arbitral awards. Through dynamic interactive lectures and scenario-based exercises, participants will have the opportunity to work in small groups in constant debate with international experts and will be taught skills, strategies, and tactics for successfully conducting a BIT arbitration.

The ASIL Private International Law Group is hosting its conference at Duke Law School, together with the Center for International and Comparative Law, and the Duke Journal of International and Comparative Law. The conference topic goes to the field’s foundation: What is Private International Law? Our goal is to push the field forward, which seems mired in its past, unable to reform sufficiently in response to current challenges of globalization. At the same time, we hope to enhance the stature of Private International Law within ASIL at large. Panels will discuss philosophical and theoretical foundations of the field, the goals of the field, its constitutional and democratic aspects, and its interrelation with legal pluralism. The speakers, chosen from responses to a call for papers, include leading academics and practitioners as well as rising stars from the United States, Canada, the United Kingdom, Europe, Asia, and Australia. Among them will be this year’s winner of the PIL prize: Sagi Peari, an SJD student from Toronto. Attendance is free for all.
